Law No. 7226 Adopting Temporary Provisions on Suspension of Judicial Time Limitations and Payment of Workplace Rents entered into force

Important amendments were made with respect to time limitations in legal proceedings and lease contracts for workplaces through the Law No. 7226 Amending Certain Codes (“Law”) which was published in the Official Gazette dated 26 March 2020 and numbered 31080 (Bis 1).

Pursuant to Provisional Article 1 of the Law, in order to prevent any loss of right as a result of the Covid-19 pandemic and subject to some exceptions, all time limitations are suspended until 30 April 2020. In this regard, all time limitations regarding arising of a right, its use or termination; time limitations prescribed by other laws regarding the parties; time limitations granted by the judge; as well as the time limitations in the mediation process shall not run from 13 March to 30 April.

Also, in accordance with the same provision of the Law, time limitations regarding the execution and bankruptcy law and time limitations set by the judge or the execution and bankruptcy offices in this regard, shall not run from 22 March to 30 April.

The power to extend the cease period for maximum of six months is granted to the President by the Law. Also, Boards of Presidents of Court of Cassation and the Council of State, Council of Judges and Prosecutors, and Ministry of Justice are addressed to determine the procedures and principles of the measures, including the deferral of the hearings.

Pursuant to the Provisional Article 2 of the Law, an important regulation is stipulated for the lease agreements for workplaces. In this context, non-payment of the rents that have risen between 1 March and 30 June, does not constitute a ground for termination of contracts or evacuation.
