Regulations on the Alcoholic Beverage Sector
The Regulation Amending the Regulation on the Technical Requirements for Alcohol and Alcoholic Beverage Facilities, Procedures and Principles Regarding their Establishment, Operation and Supervision and the Regulation Amending the Regulation on the Procedures and Principles Regarding the Domestic and Foreign Trade of Alcohol and Alcoholic Beverages (Regulations) entered into force through their publication in the Official Gazette dated 02.02.2023 and numbered 32092. Some of the important amendments introduced by the Regulations are as follows:
- The rule that the transfer of factories, plants or commercial establishments belonging to companies holding alcohol or alcoholic beverage production permits, or transfer of the right to operate such establishments or such company’s shares, to third parties is subject to the permission of the Ministry of Agriculture and Forestry remains unchanged. However, the documents required to be submitted by the transferor and transferee parties are separated.
- Import, production and placing on the market of alcoholic beverages with a packaging volume of less than 5 cl and alcoholic beverages with a packaging volume of more than 300 cl, excluding beer, are prohibited. In terms of the transition period, it is regulated that alcoholic beverages with a packaging volume of less than 5 cl and alcoholic beverages with a packaging volume of more than 300 cl, excluding beer, cannot be produced and imported as of 30.04.2023, and cannot be supplied to the domestic market by companies holding an alcoholic beverage distribution authorization certificate as of 31.05.2023, and by wholesalers, retail sellers or unpackaged alcoholic beverage sellers as of 30.06.2023.
- It is regulated that alcoholic beverages other than beer can only be supplied to the market with packaging made of glass. In terms of the transition period, it is stipulated that alcoholic beverages with packaging other than glass, excluding beer, cannot be produced and imported as of 30.04.2023, and cannot be supplied to the domestic market by companies holding an alcoholic beverage distribution authorization certificate as of 31.05.2023, and by wholesalers, retail sellers or unpackaged alcoholic beverage sellers as of 30.06.2023.
