Regulation on Remote Identification Methods to be Used by Banks and Establishment of Contractual Relations in Electronic Environment is Published
The Regulation on Remote Identification Methods to be Used by Banks and Establishment of Contractual Relations in Electronic Environment (“Regulation”) was published in the Official Gazette dated 01.04.2021 and numbered 31441. Pursuant to the Regulation, the procedures and principles regarding remote identification methods that can be used by the banks, and the establishment of contractual relations replacing the written form for banking services are set. Thus, it is now possible that banking services can be provided without physically going to the branch.
Significant rules introduced by the Regulation are summarized below:
- Prior to the initiation of remote identification process, adequate measures shall be taken and the efficiency of the process shall be subjected to a test.
- The qualification of identification cards that might be used for remote identification are set pursuant to the Regulation.
- Banks shall be responsible for ensuring that remote identification solutions that are used in a way that minimizes the risk of wrong identification.
- The conditions to be sought in order to establish a contractual relationship regarding the transactions requested by the customers that can replace a written form over an information or communication device, are set pursuant to the Regulation.
The Regulation will enter into force on 01.05.2021.
