Amendment on Unemployment Insurance Law, Labor Law and Occupational Health and Safety Law

The Law No. 7252 on Establishment of Digital Platform Commission and Amendment to Certain Laws, which amends the Unemployment Insurance Law No. 4447 (“Law No. 4447”), the Labor Law No.4857 (“Labor Law”) and the Occupational Health and Safety Law No.6331, entered into force through publication on the Official Gazette dated 28.07.2020 and numbered 31199.

Accordingly;

  • The obligation to employ occupational safety specialists and workplace doctors in public institutions and in less hazardous workplaces with less than 50 employees, has been postponed to 31.12.2023.
  • (i) End of the term in the fixed term employment and service agreements, (ii) closure or suspension of the activity of the workplace for any reason, (iii) end of the work in all kinds of service purchases and construction works, have been included among the circumstances that the prohibition of termination does not apply.
  • The President has been granted with the authorization to expend the period of prohibition of termination until 30.06.2021 each time for maximum three months.
  • The President has been granted with the authorization to expend the date of short-term working applications and/or the period of short-term working on sectorial basis separately or as a whole.

For the private sector employers who applied for short-term working allowance until 01.07.2020, a premium support in the amount of insured and employer share premiums that are regulated under the legislation are stipulated for three months until 31.12.2020, for their employees who have benefited from the short-term working allowance; in case the short-term working is terminated and they return to weekly normal working hours. Same premium support is provided for the employees of the employers who applied for unpaid leave wage support until 01.07.2020; in case they return to weekly normal working hours. The provision of premium support enters into force on 01.08.2020.
