Regulation on Promotion and Information Activities in Healthcare Services was published

The Regulation on Promotion and Information Activities in Healthcare Services (Regulation) entered into force through publication in the Official Gazette dated 29.07.2023 and numbered 32263. The significant amendments introduced by the Regulation are summarized below:
- The Regulation defines advertising, promotion and information activities in the healthcare sector.
- Advertising is prohibited in healthcare service provision. Promotion and information activities are permitted, provided that the principles set forth in the Regulation are complied with.
- The Regulation prohibits the publication of patient images taken during surgery and medical interventions and in the operating room.
- In order to use the visual content of the patient, explicit consent of the patient is required. The form published in the annex of the Regulation shall be used while obtaining explicit consent.
- A healthcare facility that is found to carry out promotion and information activities in violation of the provisions of the Regulation shall be warned twice. If it is determined that promotion and information activities contrary to the provisions of the Regulation are carried out for the third time within one year, the activities of the relevant medical department will be suspended for three days.
