Amendment on The Regulation on Technical Evaluation of Solar Energy Based Electricity Generation Applications

The Regulation Amending the Regulation on Technical Evaluation of Solar Energy Based Electricity Generation Applications (Regulation) published in the Official Gazette dated 17 January 2023 and numbered 32076 entered into force.
The main amendments made are as follows:
- Article 1 of the Regulation titled Purpose has been amended as "to determine the procedures and principles for the technical evaluation of solar energy-based pre-licence or unlicensed electricity generation activity applications and the evaluation of modification requests within the scope of pre-licence, generation licence or unlicensed generation activity".
- The definitions of "LÜY", "Unusable Area", "General Directorate" in Article 4 have been amended and new definitions, including "Maximum Power Plant Area", "Incompatible Area", "Connection Zone", "Pre-licence", "Grid Operator" have been introduced. A cap has been regulated regarding the Maximum Power Plant Area.
- New provisions were introduced regarding the technical evaluation of pre-licence applications based on solar energy, the evaluation of modification requests for applications for which pre-licence and/or generation licences have been obtained, and the evaluation of applications and modification requests made within the scope of LÜY.
- It is provided that unlicensed electricity generation applications based on greenfield solar power plants will not be allowed in respect of the plant areas for which a pre-license application has been made and EPDK has not issued the pre-license.
