The Regulation Amending the Regulation on Unlicensed Electricity Generation in the Electricity Market Entered into Force
The Regulation (“Amending Regulation”) on Amending the Regulation on Unlicensed Electricity Production in the Electricity Market (“Regulation”) entered into force following its publication in the Official Gazette with the number 31970 on October 1, 2022.
Some of the important amendments made by the Amending Regulation are outlined below:
- The Amending Regulation stipulates that the energy produced in the generation facilities within the scope of Article 5.1/h may be consumed in the consumption facility or facilities belonging to the same person without the condition of being located within the same distribution region.
- Generation facilities within the OIZ (Organized Industrial Zone) distribution license area may be associated with consumption facilities of the same person outside the OIZ distribution license area.
- For the facilities within the scope of Article 30 of the Regulation, it is not required that the generation and consumption facilities are located at the same measurement point. With the amendment, it will not be necessary for the facilities to be located in the same distribution region.
- With the Amendment, Article 30/5 of the Regulation will not be applicable for consumption facilities that procure electricity from the assigned supply company but do not use their eligible consumer rights.
- For the facilities whose transactions are carried out within the scope of Art. 26 and 30 of the Regulation, the necessary infrastructure on how the offsetting transactions will be carried out when the generation and/or consumption facilities are located within different distribution or assigned supply company regions shall be prepared by the market operator within 3 (three) months. New applications for generation facilities to be located within different assigned supply company regions and requests for facilities already in operation shall be evaluated as of 01.01.2023. The offsetting transactions of the generation facilities that are in operation as of 01.10.2022 or will be in operation until 01.01.2023 and the consumption facilities in different distribution or assigned supply company regions shall be carried out until 01.01.2023 by the assigned supply company in the region where the generation facility is located.
