The Board’s Decision Regarding Registration Obligation of Commercial Enterprises Affiliated to Associations, Foundations and Unions to the VERBIS has been Published
The Personal Data Protection Board’s (“Board”) decision dated 09.06.2021 and numbered 2021/571 (“Decision”) has been published in the Official Gazette dated 24.06.2021 and numbered 31521.
In accordance with its decisions given in 2018 and 2020, the Board had made an exemption from the obligation to register to the Data Controller’s Registry (“VERBIS”) for “associations, foundations and unions residing in Turkey which process personal data in accordance with the relevant legislation and their purposes and limited to their field of activity”.
With the aforementioned Decision, the Board aimed to clarify certain hesitations that arisen with respect to commercial enterprises of associations, foundations and unions and amended the aforesaid statement as “associations, foundations and unions residing in Turkey and those who do not have any commercial enterprise affiliated to them, that process personal data in accordance with the relevant legislation and their purposes, limited to their field of activity”.
In this respect, the associations, foundations and unions residing in Turkey and those who have a commercial enterprise affiliated to them that process personal data in accordance with the relevant legislation and purposes defined and limited to their field of activity have the obligation to enroll in VERBIS and shall submit information only concerning their commercial enterprises’ activities during their registration.
