Personal Data Protection and Cybersecurity
Personal Data Protection
With the growing prevalence of digitalization and data-driven business models, the protection of personal data has become not only a legal obligation for companies but also one of the core elements of corporate risk management. In Türkiye, in addition to Law No. 6698 on the Protection of Personal Data (KVKK) and its secondary legislation, international regulations such as the European Union General Data Protection Regulation (GDPR) have a direct impact on companies’ personal data processing activities and compliance needs.
Closely following legal and technological developments in Türkiye and abroad, Erdem & Erdem provides its clients with tailored, innovative and practicable compliance solutions in the field of personal data protection, considering their areas of activity, organizational structures and sector dynamics. Through the Personal Data Protection Compliance Programmes developed for this purpose, we adopt a holistic approach customized to the requirements of the sector in which each client operates and the legislation to which it is subject (KVKK, GDPR, etc.). These programmes aim to analyze personal data processing activities, identify legal risks and develop practicable solutions to mitigate those risks.
Our KVKK and GDPR compliance services aim to prepare or update the necessary policies and procedures, integrate compliance processes into the company’s organization, and ensure ongoing compliance as legislation and business processes evolve. To this end, we provide documentation, training and ongoing legal advisory services in critical areas such as the preparation of personal data processing inventories, the management of VERBİS processes, data security and the management of personal data breaches.
To ensure that domestic and cross-border personal data transfers are carried out lawfully under the KVKK and the GDPR, we provide comprehensive legal support on the assessment of data transfer processes and controller–processor relationships between the parties, the drafting and negotiation of data processing agreements and standard contractual clauses (SCCs), and the conduct of transfer impact assessments (TIAs). We also advise determining the appropriate international data transfer mechanisms, carrying out notification procedures before the relevant authorities, and developing legal and organizational measures to mitigate transfer risks.
In addition, we provide project-based advisory services within the framework of data protection impact assessments (DPIAs), transfer impact assessments (TIAs) and the principles of “privacy by design” and “privacy by default”, so that the projects, products and services companies plan to launch are structured in line with fundamental data protection principles from the design stage onwards.
Our team, which specializes in personal data protection, approaches data protection compliance not as a one-off exercise but as a dynamic process that requires continuous updating and improvement. On this basis, it provides clients with strategic, sustainable and ongoing legal advice.
Cybersecurity
Erdem & Erdem advises its clients, within the framework of Cybersecurity Law No. 7545 and the evolving cybersecurity legislation, on preventing cyber threats and mitigating their impact, ensuring the security of information systems and data, and establishing effective cyber incident response processes. In this context, we provide support in assessing obligations arising under the relevant legislation, monitoring existing secondary legislation and that expected to enter into force in the coming period, reviewing internal policies and procedures from a legal perspective, and structuring compliance processes in line with the obligations arising from cybersecurity legislation. In the event of a cyberattack or other security incident, we assess the applicable notification and reporting obligations under the relevant legislation, provide legal support in proceedings before the competent authorities, and advise on managing the legal risks that may arise from cyber incidents.
